Oh, I'm not saying that he possibly faked the tubal ligation (then I would tell you to sue on the grounds of medical malpractice) but that maybe he doesn't do the best job. If done correctly, tubals are 99.5% effective, but if one little part of the tube possibly isn't cauterized fully, an egg can still get through and pregnancy is possible. Perhaps if he is doing the procedure out of habit rather than putting thought and effort into them, the tubal may not have been thorough, and if it was me and it turned out that I was pregnant, I would get a second opinion.
